After being acquitted in November, 2006, of the murder of Dwayne Henley, Earl was convicted on February 9, 2007 of being a party to crime of the first degree intentional homicide and armed robbery of Michael Bizzle in August, 2000.

In May, 2005, Attorney Jensen was lead defense counsel in State v. Theodore Oswald in Waukesha County. Oswald was charged with seventeen felony counts including first degree intentional homicide. The charges arose out of a 1994 crime spree in which Theodore Oswald and his father, James, robbed a number of area banks and ultimately were involved in a shoot-out with police. Pewaukee police captian James Lutz was killed in the shoot-out. Oswald entered a plea of not guilty by reason of mental disease or defect.

February 9, 2007- Daryise Earl convicted in second trial in Racine

On Friday, February 9, 2007, after five days of trial, a Racine County jury returned verdicts finding Daryise Earl guilty of first degree intentional homicide and armed robbery arising out of the August, 2000, death of Michael Bizzle. This was Earl's second murder trial within four months. See video of closing arguments

November 17, 2006- Daryise Earl acquitted of first degree intentional homicide in Racine.

"We're really happy and relieved with this verdict," said Jeffrey Jensen, Earl's attorney. Jensen is also representing Earl in the Bizzle case.

"I think the deciding factor was there weren't any eyewitnesses to how Dwane Henley was killed and Daryise Earl had a plausible explanation to where he was that night," Jensen said.
